1. Introduction.
“New Home Magazine” (collectively, “New Home Magazine,” “we,” “us,” and “our”) recognizes the importance of protecting the privacy of the personal information you provide to us. New Home Magazine operates a consumer-facing website that (a) publishes articles, guides, home features, and other editorial content about new homes, new home construction, and home design; (b) may display information about home builders, communities, and homes; and (c) offers email newsletters and SMS alerts.
“Personal information” means information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. “Personal information” does not include publicly available information (e.g., information from government records or information lawfully made available to the general public), deidentified information, or aggregate consumer information. If we process deidentified information, we publicly commit to maintain and use deidentified information only in deidentified form, not to attempt to reidentify it, and to contractually obligate recipients to do the same.
We have developed this Privacy Policy (the “Policy”) so that you can make educated and informed decisions about the personal information that you entrust to us when you use www.NewHomeMagazine.com and any other website, mobile website, social media site, email or text-message exchange of information, and any other digital platform, including any services, features, pages, and functions contained or offered therein, that are owned, operated, or provided by New Home Magazine (collectively, the “Site”), and so you understand how we collect, use, disclose, and otherwise manage this information.
This Policy is incorporated into our Terms of Service (https://www.newhomemagazine.com/terms-and-conditions/). If there are any terms in this Policy or in our Terms of Service to which you do not agree, you must discontinue your use of the Site. PLEASE READ THIS PRIVACY POLICY CAREFULLY. BY USING OUR SITE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO THE TERMS OF THIS PRIVACY POLICY. If you do not agree with this Policy, do not use the Site or provide personal information to us.
This Policy is written in the English language. We do not guarantee the accuracy of any translated versions of this Policy. To the extent any translated versions conflict with the English language version, the English language version shall control. Our Site is intended for United States residents only.
This Policy should be read in conjunction with our Terms of Service. Any terms not defined in this Policy shall have the meaning given to them in the Terms of Service.
2. Scope.
This Policy applies to personal information collected through the Site, including when you browse the Site and view content and advertisements displayed on it, sign up for emails or SMS alerts, or otherwise communicate with us.
3. Children and Individuals Under the Age of Eighteen.
We are committed to protecting the privacy of children. Our Site is not intended for or directed to persons under eighteen (18) years of age. IF YOU ARE UNDER THE AGE OF EIGHTEEN (18) YOU ARE NOT AUTHORIZED TO USE OUR SITE, EVEN IF YOU HAVE OBTAINED PARENTAL CONSENT TO DO SO. We do not knowingly collect, request, process, or disclose data of persons under eighteen (18). Upon notice that a person under eighteen (18) has provided us with personal information, or that another party has otherwise provided us with the personal information of a person under eighteen (18), we will delete that personal information from our records and remove any associated identifiers from advertising audiences. If you are a parent or guardian and believe we have collected personal information of a person under eighteen (18), please contact us at the contact information below and we will remove such data.
4. Sources of Collected Personal Information.
New Home Magazine collects personal information from the following sources.
Information you provide to us directly. New Home Magazine collects personal information from you directly when you interact with the Site, contact us, sign up to receive emails or SMS alerts from us, participate in a promotion we offer, or otherwise communicate with us. When you use the Site, we may collect your name, email address, phone number, the content of the messages you send us, and project information when you use any interactive tools. Please do not submit Social Security numbers, government identification numbers, payment information, or other sensitive personal information that we do not request through the Site.
Information we obtain indirectly. We may receive information about you from the Service Providers (defined in Section 7) that perform functions on our behalf, such as the providers that host the Site and deliver our emails and SMS alerts. We may also receive information from the analytics and advertising platforms described in Section 6 about how you reached the Site, how you interact with advertisements displayed on the Site, and how our advertising performs. We may combine this with information we have already collected, such as your contact details, to respond to your requests and improve the Site.
Information collected automatically. When you use our Site, we collect certain information automatically through Cookies and similar technologies, including your IP address, approximate location derived from your IP address, device and browser type, operating system, screen size, device identifiers, the referring website address, the pages you view, the dates and times of your visits, and cookie and pixel identifiers, to allow us to operate and provide the Site, to understand how you interact with it, to serve, personalize, and measure advertising displayed on the Site, and to measure and deliver our own advertising on other platforms, as described below. To learn more, see the Cookies and Other Technologies section below.

For more information on retention of personal information applicable to all categories see Section 12 (Retention of Personal Information).
You may reject and opt out of Cookies and other parts of the Site. When you subscribe, sign up to receive offers, emails, or SMS alerts from us, or otherwise communicate with us through our Site, you may “opt out” of receiving future communications from us for direct marketing purposes by indicating that you decline such communications. You may choose to stop receiving our newsletter or marketing emails by following the unsubscribe instructions included in these emails or contacting us at the contact information below.
If you have opted in to our SMS alerts, you may cancel at any time by texting STOP to the number from which you received messages, and we will send you a message confirming that you have been unsubscribed. Consent to receive text messages is not a condition of purchase. As described in Sections 6, 7, and 8, we share personal information with advertising partners through Advertising Cookies, and you may opt out of that sharing at any time as described in Section 8.
Non-personal information. In some circumstances, we may collect aggregated data or anonymize your personal information (so that it can no longer be associated with you) for research or statistical purposes, such as determining which pages are most popular. Aggregated or anonymized information is not considered personal information under this Policy. Where applicable, if New Home Magazine intends to further process your personal information for a purpose other than that for which it was initially collected, New Home Magazine shall, prior to such processing, provide you with relevant information on such additional purpose and, to the extent required by applicable law, obtain your consent. To the extent you provide consent to New Home Magazine for any purpose, you may withdraw such consent at any time by contacting us at the contact information below. We do not use your personal information to train AI models and contractually prohibit our service providers from doing so. Third-party advertising and analytics partners process data under their own policies.
Sensitive personal information. New Home Magazine does not request or intentionally collect sensitive personal information through the Site, including: your driver’s license, state identification card, or passport number; your account log-in credentials; your debit card, credit card, or other payment card number, or any financial account information; your religious or philosophical beliefs or associations, political opinions or membership; the contents of your mail, email and text messages, unless we are the intended recipient of the communication; your criminal background; your citizenship or citizenship status; or any personal information about a known child. We ask that you not send or disclose any sensitive personal information to us.
6. Cookies and Other Technologies.
A “cookie” is a small file created by a web server that can be stored on a user’s device for use either during a particular browsing session (a “session” cookie) or a future browsing session (a “persistent” cookie). We use cookies, pixels, analytics software, log files, or similar technologies (collectively, “Cookies”) to collect certain information about your online activity on the Site. This information allows us to keep track of analytics, enables New Home Magazine to operate, secure, and improve the Site, and, in the case of the Advertising Cookies described below, allows us and our advertising partners to serve and measure advertising displayed on the Site and allows us to measure and deliver advertising for our Site on other platforms.
The Cookies in use on the Site fall into the following categories:
- Essential Cookies. The Site uses strictly necessary Cookies to operate and secure the Site.
- Analytics and Performance Cookies. We use Google Analytics Cookies to recognize unique visitors across sessions and to understand the pages visitors view, the paths they take through the Site, and the sources that refer them to us, so that we can improve the design and function of the Site.
- Advertising Cookies. Advertising Cookies are used on the Site in two ways:
- Advertising displayed on the Site. We work with Mediavine to manage third-party advertising displayed on the Site. Mediavine and its advertising partners set Cookies and pixels that collect identifiers and information about your browsing activity on the Site (and, in some cases, on other websites) in order to select and serve advertisements, personalize advertisements based on your inferred interests, limit how often you see the same advertisement, detect fraud, and measure advertising performance. See “Mediavine Programmatic Advertising” at the end of this Policy for more information.
- Our own advertising on other platforms. We work with third-party advertising and social media platforms, including Meta (Facebook and Instagram) and Google, that set Cookies and pixels on the Site. These Cookies transmit identifiers and information about your browsing activity on the Site to those platforms so that we can measure the performance of our advertising campaigns and show you advertisements for our Site on those platforms after you visit the Site.
The use of these Advertising Cookies constitutes “sharing” of personal information for cross-context behavioral advertising, and may constitute a “sale,” under certain U.S. state privacy laws. You may opt out of this sharing at any time as described in Section 8. We do not share sensitive personal information through Advertising Cookies.
Your choices. You may block or delete Cookies at any time through your web browser settings; if you do, some parts of the Site may not work properly for you, and you may still see non-personalized advertisements. You may also opt out of Google Analytics by installing the browser add-on available at https://tools.google.com/dlpage/gaoptout/, customize the ads Google shows you at https://adssettings.google.com/, adjust your ad preferences on Facebook and Instagram through Meta’s Ad Preferences settings, and opt out of interest-based advertising from participating companies through the Digital Advertising Alliance at https://optout.aboutads.info/ and the Network Advertising Initiative at https://optout.networkadvertising.org/. If you would like more detailed information about first-party and third-party Cookies in use on the Site, please contact us using the information below.
7. How We Disclose Personal Information.
We may share or disclose your personal information for the following limited purposes:
- Third parties providing services on our behalf. We may share information with vendors and suppliers (collectively, “Service Providers”) who perform services and functions on our behalf, such as hosting and securing the Site, delivering our emails and SMS alerts, analytics, and customer support. Service Providers do not have the right to use personal information we share with them beyond what is necessary to assist us, and we contractually require that they (1) protect the privacy of your personal information consistent with this Policy and (2) not use or disclose it for any purpose other than providing the limited service or function for New Home Magazine.
- Advertising and social media platforms. As described in Section 6, we share identifiers and internet or other electronic network activity information with Mediavine and its advertising partners, Meta, and Google through Cookies and pixels so that advertisements can be served, personalized, and measured on the Site and so that we can measure our advertising and show you advertisements for our Site on other platforms. These platforms may use the information they receive in accordance with their own privacy policies. We do not share sensitive personal information with these platforms, and you may opt out of this sharing as described in Sections 6 and 8. Mobile phone numbers, SMS opt-in data, and your consent to receive text messages will not be shared with third parties or affiliates for their marketing purposes; we use service providers only to deliver messages on our behalf.
- Aggregate information. We may share non-identifying information, such as aggregate statistics or usage information, with third parties. Any aggregated information shared in this way will not contain personal information.
- With your consent. New Home Magazine may share personal information with third parties when we have your consent to do so. If you agree to have your personal information shared with a third party, it will be subject to that third party’s privacy policy and business practices.
- Legal Obligations. We may disclose information to comply with a legal obligation; when we believe in good faith that the law requires it; at the request of governmental authorities conducting an investigation; to verify or enforce our agreements or policies, including our Terms of Service; to respond to an emergency; or otherwise to protect the rights, property, safety, or security of third parties, visitors to our Site, or the public.
- Transfer in the event of sale or change of control. If the ownership of all or substantially all of our business changes, or we otherwise transfer assets relating to our business or the Site to a third party (such as by merger, acquisition, or bankruptcy proceeding), we may transfer personal information to the new owner. Unless prohibited by applicable law, your information would remain subject to the privacy policy applicable at the time of such transfer.
- Emergencies. We may disclose personal information to appropriate law enforcement or other emergency response professionals in response to a physical threat to you or others.
Other than the sharing for cross-context behavioral and targeted advertising described above, we do not disclose personal information to third parties for their own direct marketing purposes.
8. Your U.S. State Privacy Rights.
Depending on your state of residence, you may have some or all of the following rights with respect to your personal information, subject to the conditions, exceptions, and limitations of the law of your state:
- Right to confirm whether we process, and know/access the personal information we have collected about you (including categories, sources, purposes, and third parties to whom it was disclosed), including:
- Request to Access. You may submit a request to obtain a copy of or access to the personal information that we have collected about you.
- Request to Know. You may request information on the categories of personal information we have collected about you; the categories of sources; our business or commercial purpose for collecting, selling, or sharing personal information; the categories of third parties to whom we have disclosed personal information; and the specific pieces of personal information we have collected about you. You may also request the categories of personal information we have sold or shared and the categories of third parties to whom it was sold or shared, and the categories disclosed for a business purpose and the categories of persons to whom it was disclosed. The categories, sources, and disclosures will not exceed what is contained in this Policy. We are not required to retain information used only for a one-time transaction, to re-identify personal information not stored in that manner, or to provide personal information to you more than twice in a twelve-month period.
- Right to correct inaccurate personal information. You may correct or update your personal information at any time by contacting us.
- Right to delete personal information. You may request that we delete personal information we have collected from you. Subject to certain exceptions, we will, on receipt of a verifiable request, delete your personal information from our records, direct our Service Providers to do the same, and notify third parties with whom we have shared it to delete it unless this proves impossible or involves disproportionate effort. To the extent permitted or required by applicable law in your state, we may not delete your personal information if it is necessary to: complete a request you made; protect security and prevent fraud; identify and fix technical errors; comply with legal obligations; conduct internal uses reasonably compatible with the context in which the information was collected; and establish, exercise, or defend legal claims.
- Right to data portability (a copy in a portable format). You may request a copy of your personal information in a portable and, to the extent technically feasible, readily usable format that you may transmit to another controller.
- Right to opt out of the sale or sharing of personal information and of processing for targeted advertising or profiling. As described in Sections 6 and 7, we share identifiers and internet or other electronic network activity information with third-party advertising and social media platforms through Advertising Cookies so that advertisements can be served and measured on the Site and so that we can measure our advertising and show you advertisements for our Site on other platforms. This activity constitutes “sharing” of personal information for cross-context behavioral advertising, and may constitute a “sale,” under certain U.S. state privacy laws. We do not use profiling in furtherance of decisions that produce legal or similarly significant effects. At any time, you may opt out of the sale or sharing of your personal information and of processing for targeted advertising by emailing us at [email protected] with the subject line “Do Not Sell or Share My Personal Information,” or by mail using the contact information in Section 16. You may also block Advertising Cookies through your browser settings and use the industry opt-out tools described in Section 6.
- Right to limit the use of sensitive personal information. We do not request or intentionally collect sensitive personal information through the Site, and we do not use sensitive personal information to infer characteristics about you or for advertising. If you believe you have provided us with sensitive personal information, you may contact us to request that we limit its use or delete it.
- Right to Access Information About Automated Decision-Making. We do not currently engage in automated individual decision-making. In the event we ever do so, we will inform you of such change and you may request information about and opt out of such automated decision-making.
- Right to a list of specific third parties. Residents of certain states may request a list of the specific third parties to which we have disclosed personal information.
- Appeal (in certain states). If we notify you that no action is to be taken in response to your request, you may appeal by contacting us within 30 days with the reason why you believe further action should be taken. We will respond within the period required by your state law (e.g. 45 or 60 days). Non-discrimination for exercising your rights. We may not, and will not, treat you differently because of your request to exercise your rights as residents of any state.
9. Opt-Out Preference Signals.
The Site does not currently respond automatically to browser-based opt-out preference signals, such as Global Privacy Control, or to “Do Not Track” signals. You may opt out of the sale or sharing of your personal information and of processing for targeted advertising at any time as described in Section 8. If we begin honoring opt-out preference signals, we will update this Policy. Opting out of sale or sharing will not opt you out of the marketing emails or SMS alerts you have requested; you may unsubscribe from those communications as described in Section 10.
10. Newsletters and Emails.
Newsletters and emails. At various times during your use of the Site you may be given the option of opting in to recurring informational or promotional newsletters and marketing emails from New Home Magazine, such as new articles, home features, building tips, special offers, and new resources. We deliver these communications through an email and SMS marketing provider, which acts as our Service Provider. When you provide your email address or sign up for one of our mailing lists, you may at any time choose to opt out of receiving additional informational or promotional newsletters or marketing emails by following the unsubscribe directions included at the bottom of each email or by contacting us at the contact information below. We will process unsubscribe requests within ten (10) business days. Even if you opt out of marketing communications, we may still send you transactional or administrative messages relating to the Site.
SMS alerts. If you opt in to receive SMS alerts from New Home Magazine, you will receive recurring text messages containing new content, home features, building tips, special offers, and new resources. Consent to receive text messages is not a condition of purchase. Messaging frequency may vary, and message and data rates may apply; if you have questions about your text or data plan, please contact your wireless provider. Carriers are not liable for delayed or undelivered messages. You may cancel SMS alerts at any time by replying STOP (or UNSUBSCRIBE, CANCEL, QUIT, END, REVOKE, OPT OUT), or by contacting us using any method in Section 16, after which we will send you a message confirming that you have been unsubscribed and you will no longer receive SMS messages from us, or by any other reasonable method. We will process unsubscribe requests within ten (10) business days. If you wish to rejoin, you may sign up again as you did the first time. If you are experiencing issues with the SMS program, you may reply with the keyword HELP for assistance or contact us at the contact information below. Mobile phone numbers, SMS opt-in data, and your consent to receive text messages will not be shared with or obtained from third parties or affiliates for their marketing or promotional purposes; we use service providers only to deliver messages on our behalf.
Communications with us. When you communicate with us, we may retain your communications and materials to process and respond to them and to improve the Site and our customer support. Materials you submit to us are also subject to our Terms of Service.
11. Security of Your Information.
The security of your personal information is important to us. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure, and New Home Magazine cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security. If a breach of security involving personal information occurs, we will comply with all applicable breach-notification laws. If you believe you have identified a security vulnerability in the Site, please report it to us at the contact information below. Do not access, modify, or delete data belonging to others or disrupt the Site when investigating or reporting a potential vulnerability. If you believe any personal information you have submitted to us is not secure, please notify us immediately at the contact information below.
12. Retention of Personal Information.
We retain personal information only for as long as necessary to fulfill the purposes for which it was collected, as described in Section 5 and this Section 12, and then delete or de-identify it when it is no longer needed. We retain the content of your inquiries and other communications with us for as long as necessary to respond to them and to meet applicable recordkeeping and legal obligations. We retain your email address, mobile phone number, and related subscription preferences for as long as you remain subscribed to our newsletters, marketing emails, or SMS alerts, and thereafter only as needed to honor your opt-out request and to meet our legal obligations. Information collected automatically through Cookies, including your IP address, browser and device information, and website logs, is typically retained for a shorter operational period; the Cookies described in Section 6 expire at the end of your browsing session or after a set period depending on the Cookie, and you may delete them at any time through your browser. To determine the appropriate retention period, we consider: the amount, nature, and sensitivity of the information; the potential risk of harm from unauthorized use or disclosure; the purposes for which we obtained the information and whether we can achieve those purposes through other means; whether the information is needed to provide the services you have requested, to improve the Site, and to respond to your inquiries; the need to maintain appropriate business records; compliance with our legal, regulatory, and contractual obligations; and our rights to establish, exercise, or defend legal claims. When personal information is no longer needed, we will delete, destroy, de-identify, or anonymize it in accordance with standard retention practices, subject to legal hold, backup retention, or other legal, regulatory, contractual, or operational obligations.
13. Linked Sites.
The Site may contain links to third-party owned or operated websites, including social media websites, publications hosted on such third-party websites, and the websites of home builders, lenders, and retailers (each a “Linked Site”), as a convenient method of accessing information that may be useful to you. When you click on a link to a Linked Site, you will leave the Site, and another entity may collect personal information or anonymous data from you. The inclusion of a link does not imply our endorsement of the Linked Site, and your use of any Linked Site is at your own risk. This Policy does not apply to Linked Sites; they have separate privacy and data collection practices, and we have no responsibility or liability relating to them. We encourage you to review the privacy policies of any Linked Sites you visit so that you can understand how those websites collect, use, and share your information.
14. Changes to Our Privacy Policy.
We reserve the right to change or modify this Policy at any time. Any nonmaterial changes are effective upon being posted unless we advise otherwise. If we make any material changes to this Policy, we will notify you by email or post notice on the Site before the change becomes effective. Material changes will be effective thirty (30) days after we provide notice, except changes relating to new features or required by law, which are effective immediately. Use of information we collect is subject to the Policy in effect at the time such information is used. We encourage you to frequently review this Policy.
15. Reasonable Fees.
Subject to applicable law, New Home Magazine may charge a reasonable fee for the administrative costs of any request that is manifestly unfounded or excessive.

Mediavine Programmatic Advertising
The Site works with Mediavine to manage third-party interest-based advertising appearing on the Site. Mediavine serves content and advertisements when you visit the Site, which may use first-party and third-party cookies. A cookie is a small text file sent to your computer or mobile device (your “device”) by a web server so that a website can remember information about your browsing activity.
First-party cookies are created by the website you are visiting. Third-party cookies are created by a domain other than the website you are visiting and are frequently used in behavioral advertising and analytics. Third-party cookies, tags, pixels, beacons, and similar technologies (collectively, “Tags”) may be placed on the Site to monitor interaction with advertising content and to target and optimize advertising. Most browsers let you block first-party and third-party cookies and clear your browser’s cache; check your browser’s “help” menu for instructions.
Without cookies you may not be able to take full advantage of the Site’s content and features. Rejecting cookies does not mean you will stop seeing ads on the Site; if you opt out, you will still see non-personalized advertisements.
When serving personalized ads, the Site collects the following data using a cookie: IP address, operating system type and version, device type, the language of the website, web browser type, and email address (in hashed form).
Mediavine’s partners (the companies with which Mediavine shares data) may use this data to link to other information they have independently collected in order to deliver targeted advertisements. They may also separately collect data about you from other sources, such as advertising IDs or pixels, and link it to data collected from Mediavine publishers to provide interest-based advertising across your devices, browsers, and apps. This data includes usage data, cookie information, device information, information about your interactions with advertisements and websites, geolocation data, traffic data, and information about your referral source. Mediavine’s partners may also create unique IDs to build audience segments used to provide targeted advertising.
To learn more about this practice and your choices to opt in or out of this data collection, visit the Network Advertising Initiative opt-out page (https://optout.networkadvertising.org/) or the Digital Advertising Alliance website (https://optout.aboutads.info/). To opt out in mobile apps, you may download the Digital Advertising Alliance’s AppChoices app or use the platform controls on your mobile device. For information about Mediavine’s partners, the data each collects, and their privacy policies, visit https://www.mediavine.com/ad-partners/.
